IIUSA Sues Uscis to Lengthen Sustainment Period

Washington, DC, April 8, 2024: IIUSA (Invest in the USA), the oldest and largest industry association for the EB-5 Immigrant Investor Program, filed a lawsuit against the USCIS seeking to force USCIS to lengthen the sustainment period for EB-5 investments from 2-years to 5-years.

A copy of the IIUSA notice to the public and complaint are found at the following link: https://iiusa.org/blog/iiusa-files-federal-lawsuit-to-protect-eb-5-program-integrity/

Donoso & Partners has reviewed the legal complaint and the theory of the IIUSA case. Though we cannot predict the outcome of this litigation, our best estimation is that the legal foundations for the complaint are likely to be unsuccessful.

Donoso & Partners will be scheduling a webinar in the coming weeks to discuss these and other EB-5 industry events.
